Imposing a definitive Anti-Dumping Duty (ADD) on imports of wire of non-alloy steel (not plated or not coated or plated or coated with zinc) and stranded wire of non-alloy steel (whether or not plated or coated) containing by weight 0.6 % or more of carbon with a maximum cross-sectional dimension exceeding 3 mm originating in the People’s Republic of China

The Commission have advised by Council Regulation (EC) No 383/2009, OJ L 118, a definitive ADD is hereby imposed on imports of the above products, originating in the People’s Republic of China with effect from 14 May 2009.

The products concerned are classified within the following commodity codes:

7217 1090 10
7217 2090 10
7312 1061 11
7312 1061 91
7312 1065 11
7312 1065 91
7312 1069 11
7312 1069 91

The rate of the definitive ADD applicable to the net, free-at-Community-frontier price, before duty, shall be as follows:

China – 46.2 per cent - Additional Code A999
Kiswire Qingdao, Ltd Qingdao - Nil - Additional Code A899
The following companies will pay 31.1 per cent under Additional code A952:

Ossen Innovation Materials Co Joint Stock Company Ltd Maanshan
Ossen Jiujiang Steel Wire Cable Co Ltd Jiujiang

The application of the individual duty rate specified for the company mentioned above shall be conditional upon presentation to the customs authorities of the Member States of a valid commercial invoice, which shall conform to the requirements set out in the Annex below. If no such invoice is presented, the duty rate applicable to all other companies shall apply.

The amounts secured by way of provisional ADD pursuant to Commission Regulation (EC) No 1129/2008 shall be definitively collected. The amounts secured in excess of the definitive duties as set out in Article 1(2) shall be released.

CHIEF (Customs Handling of Import and Export Freight) has been updated. The printed Tariff will be updated in the July 2009 amendment.

Annex

A declaration signed by an official of the company, in the following format must appear on the valid commercial invoice referred to in Article 1(3).

1. The name and function of the official of the company which has issued the commercial invoice.

2. The following declaration:

‘I, the undersigned, certify that the [volume] of PSC wires and strands sold for export to the European Community covered by this invoice was manufactured by (company name and registered seat) (TARIC additional code) in (country concerned). I declare that the information provided in this invoice is complete and correct.

Date and signature’.
